Interestingly, the court seemed to assume that the Second Amendment applies to state laws — what lawyers call the “incorporation” issue — which is something Heller pointedly declined to resolve.
This is more than just “interesting.” If it turns out that many - or most - lower courts begin rendering Second Amendment decisions as if Heller has already been incorporated, it will make it all that much easier for SCOTUS to decide in a future case to either incorporate Heller, or rule that it has already been incorporated.
