In a 5-4 vote, the court said the Louisiana law allowing the death penalty to be imposed in such cases violates the Constitution’s ban on cruel and unusual punishment.
“The death penalty is not a proportional punishment for the rape of a child,” Justice Anthony Kennedy wrote in his majority opinion. His four liberal colleagues joined him, while the four more conservative justices dissented.
This sort of split - in this sort of ruling - does the liberal cause no good at all.
I hope somebody asks Obama whether he agrees with the liberals on this issue, or the conservatives.
I’m pretty sure that something like 99.6 percent of American parents would support the death penalty for some monster who raped their eight year old daughter. I know I would. I’d even cheerfully administer it.
The notion that “civilization” involves deliberately refraining from ridding civilization of barbarian savages who would destroy it is not just uncivilized, it is self-destructive to the point of insanity.


I’m all in favor of evisceration followed by drawing and quartering. If the shitheel survives, well, I can live with that.
Anyone who touches either one of my children in this way won’t have to worry about the state removing him from this mortal coil. In fact, he’d better pray that the police get their hands on him before I do.
Well, considering what the other prisoners do to child molesters/child rapists, I can’t really argue with this decision. I’d much rather those scumbags are around for as long as possible so they themselves can be raped as often as possible.
Sorry, I can’t support state-sanctioned torture, which is what you are talking about, growler, even in cases like these. Such things corrupt the entire justice system.
My problem is with banning the death penalty for such cases. Even without the ban, the state would still be free to practice torture if it desired.
What is it that leads a culture to have an “every-life-is-precious” fetish? Does it signal a higher appreciation of life, or in some sinister way, it’s exact opposite?
I don’t think it’s “every-life-is-precious” since keeping these monsters alive often results in more death and destruction. I believe it is just the left pandering to another group, trolling for votes and power, with no regard for the consequence.
Buddhists believe that every life is precious. But they hack the head off a rapist without hesitation.
Once again, a 5-4 decision, Kennedy running with the liberals so he gets to write the opinion he hopes will make him as famous as Harry Blackmun. Somehow, I don’t see this one doing it, any more than all the others.
Whatever his intent, Anthony Kennedy has positioned himself as the most powerful man in America.
I suppose it would be too obvious to point out that is precisely his intent?
